Four Seasons POA Rules & Regulations
These rules and regulations have been
adopted by the Four Seasons Lakesites POA Board of Directors and, accordingly,
have become part of the Four Seasons Declaration of Protective Covenants, enforceable
under the same terms and conditions. They are offered to ensure all
owners have reasonable use and access to all common areas and amenities and
quiet enjoyment of their property.
RULES AND REGULATIONS / GENERAL
RESIDENTIAL
A). ELIGIBILITY:
The rights and privileges of Four
Seasons Lakesites Property Owners Association, Inc. are extended to members in
good standing who have paid all dues and assessments.
B) GENERAL RULES AND RESTRICTIONS:
Trash receptacles shall be placed
behind or inside an approved trash enclosure, so as not to be visible from the
street,
The burning of garbage, trash, or other
refuse is not permitted.
All homes in Four Seasons shall be
clearly identified with lot and subdivision number either on trash enclosure or
on a sign clearly visible from the road. Such signs are not to exceed 6 x 18
inches with 3-inch letters and numbers depicting the lot and subdivision.
No accessory or "out"
buildings are permitted on any lot without prior approval of the ACC.
Owners of improved and unimproved lots
shall prevent their lots from becoming unsightly, unsanitary or a hazard to
health. If not so maintained, the Association shall have the right to do
so; the cost of which shall be added to and become part of the annual
assessment to which such lot is subject.
No member shall be allowed to circulate
any subscription list, place any advertisement or sign, or exhibit any article
for sale on their lot, dock or improved property, including common areas and
property belonging to Four Seasons Lakesites POA, unless an exception is
granted by the Board of Directors. Examples of such exceptions would
include a properly registered "Open House" sign.
No travel trailer, motor home, mobile
home, boat, boat trailer, utility trailer, or commercial vehicle shall be
placed on any lot unless garaged in a manner approved by the ACC. A
locked storage facility is provided on
Overnight camping on any lot or any
common area (except the Campground) is prohibited.
No used buildings or structures
intended for use as a dwelling shall be placed on any lot.
Owners of lots adjacent to golf course
fairways shall permit the entrance upon their lots for retrieval of golf balls
and shall be subject to Golf Course Committee rules and regulations in addition
to all other rules and regulations to which they are to be subjected.
Each owner shall keep drainage ditches
and swales located on his/her lot free and unobstructed and in good repair and
shall provide for the installation of such culverts upon his/her lot as may be
reasonably required for proper drainage.
No drilling, refining, quarrying or
mining operation of any kind shall be permitted on any lot.
No lot shall be further subdivided by
subsequent owners except those designated multiple-family residential and then
only to the extent required or permitted by governmental authority. The
developer retains the right to re-subdivide lots prior to the time of the
original sale.
Lots may be subdivided if all portions
of the lots subdivided are conveyed to the owners of an adjacent lot(s),
thereby enlarging such lot(s). The boundary between the enlarged lot(s)
shall constitute the new back and side lines for the purposes of the
Restrictive Covenants. The subdivision authorized by this section shall
be effective only if the owners of the lot being subdivided and the owners of
the lots being enlarged join in the execution of an indenture, setting forth
the new boundary of the enlarged lots. The indenture shall be approved in
writing by the President of the POA and recorded in the Office of the Recorder
of Deeds,
No construction or exterior change to a
property may be made without the expressed written approval of the ACC.
The permitting process by the ACC may or may not require a fee and/or damage
deposit. A building guide, detailing all construction
criteria, is available at the ACC office at
Construction of any improvement, once
approved, shall be completed in a timely manner. The time of construction
shall commence as of the date the building permit is issued.
All outdoor clotheslines and poles
shall be screened or hidden by shrubbery so as not to be visible from any
street or the

The Association prohibits noxious or
offensive activities which annoy or become a nuisance to other property owners,
or otherwise interfere with the right of "quiet enjoyment".
No animals, livestock or poultry of any
kind shall be housed, raised or kept within Four Seasons, except that commonly
accepted household pets (not including horses) may be kept, provided they are
not kept or maintained for any commercial purposes, and are not a nuisance
to adjoining property owners. Dogs may be kept upon a lot by the owner of
said lot, so long as the dogs are securely confined in an enclosure such as a
pen, restricted by a suitable leash or chain, or if having been fully trained,
are at all times in voice control of the owner and are not running at
large. Unconfined dogs outside the owner's control will result in a
violation by the dog's owner and owner will be subject to fine. Owners
allowing incessant barking of dogs under their control will also be subject to
fine.
Hunting and the firing of weapons
within the confines of Four Seasons Lakesites POA subdivisions are absolutely
prohibited. Exceptions may be made for managed hunts authorized by the
POA Board of Directors, but only after application and appropriate registration
has been completed.
Off-road vehicles are not permitted on
common property, roads or road right-of-ways. Exception: Off-road vehicles, registered and with current state license,
may use paved roadways.
GUEST PRIVILEGES:
The number of guests which a member may
have for the purpose of swimming and/or use of recreational facilities are not
limited, providing guests are accompanied by a member and prior
arrangements are made for groups of 12 or more. The requirement of
"presence of a member" is fulfilled if the member is generally
participating in activities in which the guest(s) is (are) engaged and when the
member is within the range of reasonable communications with guests.
Property owner's guests may not launch
their own boat from Four Seasons boat launch ramps without the presence and
participation of the owner.
No Four Seasons property owner, nor
members of their immediate family, shall be allowed to engage in any facility
or amenity use, nor any owner privileges, unless they are
members in good standing, nor shall they qualify as guests of members
under any circumstances.
Guests are permitted to use the Robert
Trent Jones Championship Golf Course only when accompanied by a POA member in
good standing. Guests are expected to pay the standard course fees and
reserve a tee time. Four Seasons Lakesites POA
shall not be responsible for the loss of property, or for any other loss
sustained by members or their guests, while on Four Seasons Lakesites POA
premises.
Each of the restrictions listed herein
and in the Declaration of Restrictive Covenants is independent from each of the
others and does not affect the enforceability of any of the others. The
Four Seasons Lakesites POA Board of Directors reserves the right to
amend or add to theses rules and regulations as may be necessary to ensure the
safety and well being of all members of the Association.
RULES & REGULATIONS / PROPERTY
OWNERS CARDS
A. ELIGIBILITY:
Four Seasons Lakesites Property Owners
in good standing and their sponsored guests.
B. DEFINITION:
Permanent Owners Cards are plasticized
cards which are issued as outlined below and are valid until the annual billing
cycle of the following year is completed.
Temporary Ownership Privilege Cards are
issued as outlined below and include a specific expiration date.
C. GENERAL RULES:
Permanent Owners Cards:
Cards will be issued bearing only the
names of the owners indicated on the property deed. Permanent cards are
not issued for family members of property owners.
Two (2) permanent cards will be issued
annually to a single owner or to a pair of owners, and no more than four (4)
cards may be issued to a group of owners.
New owners will receive permanent cards
after a recorded copy of the property deed is received by the management
office.
Only one set of permanent cards will be
issued regardless of the number of lots owned.
Cards will be issued only after
assessments have been paid for all property owned by that individual or group.
Replacement sets for lost cards will be
provided at a cost of ten dollars ($10.00) to the owner.
Temporary Ownership Privilege Cards:
Timeshare owners of Four Seasons
Lakesites condominiums may be issued cards during their interval week, which
will remain valid until the same week of the following year.
At the request of an owner in good
standing, temporary cards can be issued for guests staying in the owner's home
or at the Campground. The names of the visitors and the beginning and
ending dates of the visit must be specified.
Cards may be provided for lessees of
Four Seasons Lakesites property, provided the
following conditions apply:
Property owner completes the Temporary
Associate Membership Application on behalf of the lessee.
Property owner has paid assessments in
full.
Property owner relinquishes amenity
privileges for leased property.
Property owner has paid any additional assessments
required for multi-family units, per Four Seasons Lakesites Declaration of
Restrictive Covenants. Example: Owner of multi-family assigns membership card
to first tenant in a four-unit complex. First tenant is re-issued a
temporary card. Tenants two through four may then purchase temporary
cards at a specific additional rate (currently $120.00 annually).
RULES AND REGULATIONS / BOAT LAUNCH
AREAS
ELIGIBILITY:
Boat launch areas are available only to
Four Seasons property owners in good standing. Guests of property owners
may launch boats from boat launch areas but only in the presence of and with
the participation of sponsoring owner.
GENERAL RULES:
No swimming from the boat launch ramps.
No overnight parking of boats, trailers
or cars.
No littering or dumping in the boat launch areas.
Vehicles and trailers left in the
launch areas must be positioned so as not to block ingress, turn ability, and
egress of others.
RULES AND REGULATIONS / RECREATIONAL
LAKES
ELIGIBILITY:
The three recreational lakes within the
community of Four Seasons, are available for use by any Four Seasons property
owner in good standing. Guests, if accompanied by owner, may use the
lakes.
Anyone fishing must have a valid
REGISTRATION:
Owners of any boat using the
recreational lakes shall obtain a registration number from Four Seasons
Lakesites Security. If registered with the state, that number shall be
used.
Persons owning frontage property may
leave boats overnight between their lot lines
extended. Any boats left at a recreational lake, on common property, (not
within private property lot lines extended) shall obtain a permit from Four
Seasons Security.
GENERAL RULES:
All fishing shall be pole and
line. NO gigging or trot line fishing allowed.
No personal watercraft or boats powered
by anything other than electric trolling motors, sails, paddles, or oars
allowed on the lake.
No docks or piers allowed.
Property between the lot closure line
and the shoreline is the property of the POA. Individual lot owners of
developed property shall be allowed to make minimal improvements on this
property. Examples of minimal improvements include cleaning of dead
vegetation, high cutting of grass, or placement of nonpermanent items such as
lawn chairs or nonpaved footpaths. Improvements
not allowed are the erection of any permanent structures, pouring of sidewalks,
or changing of grade.
Homeowners are encouraged to plant
native vegetation and to refrain from fertilizing the portions of their lot in
proximity to the lake. NO fertilizer is to be applied on the lakeward side of the lot line.
Pre-existing structures outside the
closure line on the lakeward side will be allowed to
stand but cannot be improved.
Four Seasons owners of improved
property on a recreational lake must file a shoreline improvement plan within
one year of approval of rules. Said plan will provide a general plan
for improvement and maintenance of their portion of the shoreline. Any
future lot development fronting recreational lakes must include this plan as
part of their site plan.
No additional fees are to be charged if
filed within on one year. In the event the homeowner wishes to amend
their plan it will be treated as a regular landscaping project in the
assessment of fees.
RULES AND REGULATIONS / BOAT, TRAILER
AND RV STORAGE
A. ELIGIBILITY:
For use by Four
Seasons property owners in good standing.
B. REGISTRATION:
Leases shall be completed and monies
collected by a Four Seasons security officer prior to use of the
facility. Property owner must present current property owners card to the
officer at the Security office, located at the POA Lounge on
Monies due are payable in the form of
cash or check payable to Four Seasons Lakesites POA. Officer will make
copy of check for owner's records and provide a receipt.
C. GENERAL RULES:
The rental rate is currently $96.00
annually per item. All monies must be paid in full, at the execution of
the lease agreement.
The lease agreement for equipment
storage will include a complete description of the storage item, all
identification numbers, and the owner's lot and subdivision number. A
copy of the lease will be provided to the owner.
When item is permanently removed from
storage, the POA will reimburse a pro-rated share of lessee's annual fee.
This policy is designed for long-term
storage; therefore, owner is allowed one free "out-and-in" (of stored
items) per month. Each out-and-in beyond one (in any calendar month) will
be assessed a $5.00 charge. If item is not returned to the storage lot
within 60 days of its removal, the contract may be terminated, and prorated
funds returned to owner.
Renter shall secure his/her own
insurance policy for stored item(s) and provide insurance carrier with a copy
of storage lease agreement. Four Seasons Lakesites POA
is not responsible for theft or damage of any kind which may occur to item(s)
in storage.
Access to and from storage shall be
through Four Seasons Security only, 365-8560.
RULES AND REGULATIONS / CAMPGROUND
A. ELIGIBILITY:
The Campgrounds are designated as
"private" and are for the use and benefit of Four Seasons Lakesites
property owners in good standing, their families and sponsored guests.
B. DEFINITION OF A CAMP:
A "camp" shall be considered
a single family occupying ONE SITE with one or more camp shelters as needed.
A "family" shall be defined
as parent(s) and IRS dependents.
No more than one single family may
occupy one campsite without paying for an additional site. A single
family of such size that it cannot comfortably occupy one site will be required
to use as many sites as necessary.
Guests may occupy the property owner's
site in a tent or owner's camper or may occupy a second site at the regular fee
on a space-available basis.
C. REGISTRATION:
Nightly fees are currently $15 for 30
amp. site, $12 for 15 amp site and $5 for tent site.
Advanced reservation and payment is
required for property owners and guests of property owners wishing to reserve
sites at the Campground. Contact the POA Management office at 365-6628 or stop
by the office at
Property owners must show current POA
card to use Campground facilities or to register a guest to stay at the
Campground.
Reservation permit must be displayed on
the campsite post at all times during stay.
Guests of property owners in good
standing must be registered and paid for by the sponsoring Four Seasons
property owner.
Reservations may be extended on
space-available basis and upon advanced payment.
All campers must follow the rules and
regulations of the Campground. Minor dependents of POA owners shall provide
written parental approval prior to obtaining a camp or tent site.
Children under the age of 16 must be accompanied by a parent.
D. STORAGE:
NO vehicles, campers, boats or trailers
may be stored at the Campground at any time. A secured storage area is
available on a first-come / first-serve basis. Contact the Security
Department for registration and access, or assistance. The phone number
is 365-8560. Towing to and from storage is the owner's
responsibility. Vehicles are stored at the owner's risk. Four Seasons Lakesites POA accepts no responsibility for
theft or damage.
E. GENERAL RULES:
Camping permit stubs must be displayed
at the campsite (on the campsite post) and visible at all times.
After 11:00 p.m., all campers must be
respectfully quiet.
Rowdyism, loitering, profanity, or other acts
disturbing to others will not be tolerated. Security will vacate
any campsite of campers unwilling to comply with appropriate standards of
behavior. Offenders may have their camping privileges removed for the
remainder of the year.
All garbage and refuse must be put in
plastic bags and placed in refuse containers. DO NOT PUT FISH ENTRAILS IN
DUMPSITE.
A container must be kept under any recreational
vehicle (RV) drain and emptied at the sanitary dump area. Holding tanks
must be dumped at the sanitary dump area only.
No dish washing will be allowed at the
water fountains or in the restrooms.
Vehicles are not to block roadways. The
center lane must be kept clear at all times to allow access to water and
electric facilities.
No tents may be pitched in RV areas and
no RV's may be parked in the tent areas.
Pets are not allowed in the rest rooms,
and they must be on a leash not exceeding six feet in length at all times.
Motor-driven vehicles such as
motorcycles, mini-bikes, and go-carts are not to use the roads in camp, except
to enter or leave.
Speed limits (15 m.p.h.)
are to be observed at all times by all vehicles.
All campfires must be confined to a
fire pit. NO FIRES ARE TO BE LEFT UNATTENDED. Fires must be
extinguished after use.
Electrical plugs must be unhooked at
the pedestal when motor home and/or truck campers leave their sites.
All campsites and surrounding areas
must be kept free of litter.
At no time shall a campsite be used as
a "permanent residence."
RULES AND REGULATIONS / SWIM AND
TENNIS CLUB, BITTERSWEET POOL , REGENCY COVE POOL AND
A. ELIGIBILITY:
The pools are available at no charge to
members in good standing and their accompanied guests.
Anyone using any of the Four Seasons
Lakesites POA pools and facilities are required to have their membership cards
with them and sign the pool register. Guest must be accompanied by a
property owner. Temporary Associate Membership Cards may be obtained at
the Four Seasons POA office located at 2140 Bagnell
Dam Blvd., Cliffside Centre suite 101.
B. REGISTRATION:
The pavilions may be reserved for
private, personal and social events with a $100.00 refundable damage deposit.
No business functions are permitted. It is not possible to grant
exclusive use of the pools. Reservations help avoid overloading the
facilities and staff. Reservations and deposit must be made 48 hours in
advance.
Activities previously planned for all
property owners will take precedence over private, personal and other social
events.
Management reserves the right to
disband any private function which in the judgment of the staff, Security, or
the Activities Director, becomes a safety hazard or a nuisance to other patrons
or surrounding homeowners.
C. GENERAL RULES:
Pool rules are as follows:
No
smoking in the immediate pool deck area.
No glass
in the pool area.
No
alcohol in the immediate pool area.
No
running or rough play.
Only
swim wear allowed in the pool.
Do not block the emergency entrance in
any way.
No children under 12 permitted in the
pool area without an adult present.
Please shower before entering the pool.
No pets allowed in the immediate pool
area.
Members using the pavilion and barbecue
areas are responsible for extinguishing their fires and completing the clean-up of their picnic area. This includes
trash removal. There will be a minimum of $25.00 charged for removing
trash or for cleaning the area after a private function, if, in the opinion of
staff, area is not adequately cleaned by user.
Absolutely no consumption of alcoholic
beverages by minors is allowed.
The boat docks at the Swim and Tennis
Club are available for temporary use by property owners in good standing only.
No overnight docking is permitted. Absolutely no gasoline is permitted on
the dock.
Swimming is not permitted from the dock
or from the
Tennis courts are available on a
first-come / first-serve basis, with play limited to one hour when others are
waiting. Posted rules are incorporated herein. One court may be
reserved for a private function during a designated time frame.
Tennis shoes only on
courts, no black soles.
No skate boards, roller blades,
bicycles or like allowed on tennis courts.
No overnight parking in any of the
above facilities.
RULES AND REGULATIONS / POA LOUNGE
A. ELIGIBILITY:
The POA Lounge is available to members
in good standing (assessments current) for private, personal and social
events. No business functions are permitted. Included in this
definition of “business functions”, but not limited to these, are: sales
presentations, non-Four Seasons association meetings, political functions, or
any “public invitation” type functions. The board or manager reserves the
right to terminate and cause forfeiture of deposit for any event which, in
their opinion, violates this rule.
B. REGISTRATION & FEES:
Reservations for use of the Lounge or
any portion thereof must be made at least 48 hours in advance. Any
reservations not confirmed at least 48 hours prior to the event are subject to
cancellation. A confirmation of a reservation is complete when a signed
reservation form and the appropriate fees have been received by the POA Activities
Department. Reservation forms are obtained at the POA office at Ste. 101
Cliffside Center,
2. Any group
requesting regularly scheduled use of the Lounge must consist of a majority of
POA members and must complete a registration form (yearly) as well as adhere to
the rules set forth. A damage deposit of $100.00 shall be tendered and
must be replenished if falling below $75.00.
3. When making a
reservation, a deposit of $300.00 will be collected. The $300.00 deposit
is held as a cleaning/damage fee with $280.00 of this fee being refundable
after the event if the lounge is damage free and is cleaned properly. Twenty
dollars of the deposit is non-refundable, which pays for the bathrooms to be
professionally cleaned after your event. Additionally, a non-refundable
base rental fee (effective 12/14/00) of $300.00 will be collected, plus a
surcharge of $50.00 for a regular event and a wedding/wedding reception
surcharge of $100.00. The base rental fee needs to be received at least two
weeks prior to your event.
C. CLEANING FOR PRIVATE EVENTS:
The fee for cleaning after a private
event will be deducted from your deposit. Contract cleaners will be hired
to clean the Lounge according to POA set standards. Cleaners will report time
and charges to the Activities Director, who will refund the excess cleaning fee
(if any), along with the damage deposit refund (if any). There will be a
minimum cleaning charge of $21.00. All decisions concerning cleaning
charges are solely up to management and are not negotiable. Management
will be fair and consistent when determining charges. Charges will be
based on actual cleaning costs charged to the POA. Should your cleaning fee
exceed your deposit, you would be responsible for remaining fee.
D. ROUTINE CLEANING:
The POA Lounge will be cleaned daily
(Monday through Friday) from 8:00 a.m. to 9:00 a.m., to cover casual use and
regularly scheduled groups. (Note: Regularly scheduled groups must perform all
cleaning functions listed in paragraph E-7. Failure to do so will result in
cleaning charges taken from group's damage deposit. The need for
additional cleaning will be the sole decision of management.)
E. GENERAL RULES:
1. Property owners
requesting use of the fireplace will so designate on the Reservation
Form. POA management will then notify Security to have the propane
fireplace started and then turned off at the conclusion of the event.
2. Scheduled POA
activities planned for all property owners will take precedence over private,
personal and other social events.
3.
The
property owner reserving the POA Lounge MUST be
present for the duration of the private function he/she sponsors. If
he/she must leave before end of function, he/she is to appoint a responsible
alternate and report this person's name to the Activities Director or Security
(365-8560) before the end of the function.
4.
POA groups or specific POA members
reserving the Lounge for a private function WILL BE
HELD RESPONSIBLE FOR ALL INVENTORY ON THE PROVIDED INVENTORY LIST. Responsible
party will be held liable for all costs of broken, damaged, or missing POA
property beyond the cost of the initial damage deposit.
The POA Lounge interior has a maximum
capacity of 400 persons standing (
6. All decorations
brought into the Lounge for a function must be removed at the completion of the
activity or event. Care should be taken with use of decorations.
Tape of any kind, staples, nails or tacks are prohibited. Property owner
will be held responsible for any damage to the paint or wallpaper.
7. AT THE END OF ANY
PRIVATE EVENT, IN ORDER TO AVOID EXCESSIVE CLEANING CHARGES, THE
RESPONSIBLE PARTY WILL ENSURE THAT: This applies to all scheduled functions as
well.
a.) Any moved furniture is replaced to its original position.
b.) Soiled areas, kitchen and
bar area are cleaned and vacuumed as necessary.
c.) Coffee pots are cleaned and
burners are turned off (do not unplug).
d.)
Countertops and tables are wiped clean.
e.)
Trash is removed and deposited into receptacle outside the building.
f.)
Upon departure, all items brought in, especially leftover food, are to be
removed. Non-perishable items found in the Lounge will be brought to the
lost-and-found, located in the security office in the POA Lounge basement.
g.)
All doors and windows are locked.
h.)
Security is contacted at 365-8560 or in person (basement level) to inform them
the event has ended. (Security will check the fireplace and do an overall
inspection of the facility.)
i.)
The weekly calendar of posted events is observed. If an event follows
yours, or coincides with yours, please be courteous.
Note: Bathrooms will be cleaned by professional cleaning staff only.
8. THE POA LOUNGE IS
A NON-SMOKING FACILITY. There are designated smoking areas outside the
building. Please do not throw cigarettes/cigars over the deck railing or
anywhere on POA Lounge grounds.
9. If you incur a
situation where repairs are necessary, or you find inventory missing, please
notify the Activities Director at 365-6628 during office hours, Monday through
Friday, 8:30 a.m. to 5:30 p.m. Before and after hours, notify Four Seasons
Security at 365-8560.
Minors using the Lounge for any
purpose, other than a scheduled supervised event, must be accompanied by a
responsible adult member.
11. Prior to your scheduled event at
the lounge, the Activities Director will do a walk-thru with you. The
purpose of the walk-thru is to make sure that you are able to find
what you need for your function, i.e. dishes, trash bags, etc.
and where trash receptacles are located. The purpose also is to ensure you know
how to use the equipment you have available to you, i.e. sound system,
coffee pot ,etc., and where light & fan switches are located. Please
feel free at this time to ask any questions you have. The final step of the
walk-thru will be instructions on securing the building at the end of the
event.
